There is a saying that life begins after 40 years.
I think it also could be about the duration of punishment under the law ie., in this case 40 years to life, where the criminal has to be in jail for a minimum period of 40 years with a chance for parole after this period. So the criminal could be in jail for anywhere between 40 years to as long as he lives.
